Kirk had been sentenced to four months in jail prior to the dismissal of his charges.

The dismissals come as Essayli’s leadership has faced scrutiny, particularly after the abrupt firing of Assistant U.S. Attorney Adam Schleifer, who played a key role in prosecuting Wiederhorn. Reports suggest that shortly after his appointment, Essayli met with Wiederhorn’s legal team and indicated that charges against him could be dismissed if he were to be appointed permanently.

Wiederhorn has consistently denied the allegations against him throughout the legal proceedings. This included the dismissal of charges alleging a conspiracy with former CFO Rebecca D. Hershinger and accountant William J. Amon, as well as the removal of a firearm possession charge, despite Wiederhorn’s previous convictions which legally ban him from possessing weapons.

In another significant case, Alejandro Orellana, a former Marine accused of aiding civil disorder amid protests against immigration raids, also had his charges dismissed. Orellana asserted that his actions were intended to be part of peaceful demonstrations.
